Terms and Conditions, ARK Cases
Article 1, Definitions
In these terms and conditions, the following definitions apply:
Entrepreneur: the natural or legal person offering products under the name ARK Cases.
Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
Distance contract: an agreement concluded between the entrepreneur and the consumer as part of an organized system for distance sales, using one or more means of distance communication.
Means of distance communication: any method that can be used to conclude an agreement without the consumer and entrepreneur being present in the same room at the same time.
Cooling-off period: the period during which the consumer may exercise the right of withdrawal.
Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period.
Day: calendar day.
Durable medium: any tool that enables the consumer or entrepreneur to store information in a way that allows future consultation and unchanged reproduction.

Article 3, Applicability
- These terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
- Before the agreement is concluded, the text of these terms and conditions will be made available to the consumer.
- If the agreement is concluded electronically, these terms and conditions will be made available in such a way that they can be easily stored.
- In the event of a conflict between additional terms, the provision most favorable to the consumer shall apply.
Article 4, The Offer
- If an offer has a limited period of validity, this will be clearly stated.
- The offer contains a complete and accurate description of the products offered.
- Images are a truthful representation of the product. Obvious errors do not bind the entrepreneur.
- The composition of products may be changed in certain parts, provided this does not affect the functionality of the product.
Article 5, The Agreement
- The agreement is concluded at the moment of acceptance by the consumer.
- The entrepreneur confirms receipt of the order electronically.
- The entrepreneur takes appropriate security measures for electronic payments.
- The entrepreneur may refuse an order if there are justified reasons.
Article 6, Right of Withdrawal
- The consumer has the right to withdraw from the agreement within 14 days without giving any reason.
- During the cooling-off period, the consumer must handle the product with care.
- The product may only be unpacked to the extent necessary to determine whether the consumer wishes to keep it.
- The product must be returned complete, unused and, where reasonably possible, in its original condition and packaging.
Article 7, Costs in Case of Withdrawal
- The consumer bears the costs of return shipping, unless stated otherwise.
- Reimbursement will take place within 14 days after receipt of the returned product.
Article 8, Exclusion of the Right of Withdrawal
- Products may be excluded from the right of withdrawal if this has been clearly stated in advance.
- Exclusion is possible for:
- products that cannot be returned for hygiene or safety reasons
- products where the seal has been broken
Article 9, The Price
- All prices include VAT.
- Price changes after purchase do not apply to agreements that have already been concluded.
Article 10, Conformity and Warranty
- The entrepreneur guarantees that the products comply with the agreement.
- The entrepreneur does not provide any guarantees regarding suitability for specific emergency situations or circumstances.
Article 11, Delivery and Fulfilment
- Delivery takes place at the address provided by the consumer.
- Delivery times are indicative and do not entitle the consumer to compensation if they are exceeded.
- If delivery is not possible, a suitable alternative will be offered or the amount paid will be refunded.
Article 12, Payment
- Payment must be made using the payment methods offered.
- The consumer is obliged to immediately report any inaccuracies in payment details.
Article 13, Complaints Procedure
- Complaints must be reported within a reasonable period.
- Complaints will be answered within 14 days.
Article 14, Liability and Use
- ARK Cases products are intended as supporting systems for temporary interruptions of essential services such as power, water, or communication.
- The products do not guarantee safety, survival, or the prevention of damage in all circumstances.
- The user is responsible for the correct use of the product.
- ARK Cases is not liable for damage resulting from incorrect or incomplete use.
Article 15, Applicable Law
All agreements are governed exclusively by Dutch law.
Article 16, Amendments to the Terms and Conditions
Changes to these terms and conditions take effect after publication on the website.
